GENERAL TERMS AND CONDITIONS OF BIKE RENTAL AGREEMENT

1 – Purpose

These terms and conditions ("Terms") govern the rental of bicycles between Kargoo, a self-employed individual ("Lessor"), and the subscriber to the rental agreement ("USER").

  • 1.2 By proceeding with the rental, the USER acknowledges and accepts these Terms.
  • 1.3 The USER fully accepts these Terms without any reservations.
  • 1.4 The USER has the option to save or edit these Terms, but it should be noted that they are subject to changes. The Terms in effect at the time of reservation or immediate availability of the specified equipment in the rental agreement will apply.
  • 1.5 The USER declares that they have the legal capacity to enter into this contract.

2 – Rental Requirements

  • 2.1 The Lessor may request an identity document from the USER, and a copy may be retained.
  • 2.2 The USER confirms their ability to ride a bicycle and declares no medical contraindications. They agree to use the bicycle within their capabilities. The Lessor cannot be held responsible for damages resulting from the USER's lack of competence.

3 – Reservation

  • 3.1 The Lessor will confirm the acceptance of the customer's reservation by sending a confirmation message to the provided email address.
  • 3.2 The Lessor reserves the right to refuse or cancel any reservation
    From individuals who do not meet the rental requirements.
    From individuals unable to provide the security deposit.
  • 3.3 The information provided by the USER during the reservation process is binding. The Lessor cannot be held responsible for input errors made by the USER, including delivery delays or the inability to deliver caused by these errors.

4 – Cancellation and Modification

  • 4.1 The USER may cancel their reservation under the following conditions:
    Up to 7 days before the scheduled possession of the equipment: a full refund will be issued.
    Less than 7 days before the scheduled possession of the equipment: no refund will be provided.
  • 4.2 Any refund will be issued within 14 days from the receipt of the cancellation request.
  • 4.3 The USER has the option to modify their reservation without any additional charges, provided that they notify the Lessor at least 48 hours prior to the rental commencement.
    The USER acknowledges that revised rental prices may apply based on the selected date, duration, and equipment.

5 – Effective Date and Duration of the Contract

  • 5.1 The rental agreement becomes effective upon signing and upon the availability of the equipment following full payment.
  • 5.2 Upon delivery, the USER assumes full responsibility for the safekeeping of the bicycle and accessories, and all associated risks are transferred to the USER.
  • 5.3 The rental period and custody of the equipment conclude when all rented items are returned to the agency.

6 – Lessor's Rights

  • 6.1 The rented equipment exclusively belongs to the Lessor.
  • 6.2 The USER agrees not to grant any rights to third parties that may adversely affect the enjoyment, availability, or ownership rights of the equipment.

7 – Loan and Subleasing

  • 7.1 The bicycle and any accessories may only be used by the individual who signed the contract and cannot be lent to others.
  • 7.2 Subleasing the equipment is strictly prohibited.

8 – Prices and Payment

  • 8.1 Rental rates, based on the equipment range and rental duration, are clearly displayed on the website https://www.Kargoo.ma .
  • 8.2 The USER is required to make full payment under the following conditions:
    – In cases of immediate availability: at the time of the rental agreement.
    – In cases of reservation: at the time of reservation.
  • 8.3 Accepted methods of payment are: credit card and cash.

9 – Security Deposit

  • 9.1 Upon contract signing, a security deposit may be requested from the USER. The deposit amount will not be collected at that time but may be collected if any obligations under these Terms are breached, as determined during equipment return. The security deposit will be refunded at the end of the rental contract if no additional costs are incurred. The security deposit does not limit the Lessor's liability in any manner.

10 – Provision

  • 10.1 In the event of bicycle unavailability, the Lessor reserves the right to refuse any rental request.
  • 10.2 The Lessor shall not be held accountable for delays in availability or delivery beyond their control, and no compensation shall be provided in such circumstances.
  • 10.3 Upon equipment provision, the USER is encouraged to inspect the condition of the equipment. Any concerns regarding the equipment's condition must be noted on the contract during signing. In the absence of any concerns, the bicycle and accessories are assumed to be in excellent working condition.

11 – Use

  • 11.1 Wearing a helmet is strongly recommended by the lessor and is mandatory for children under 12 years old. The lessor declines any responsibility in case of non-use of safety elements.
  • 11.2 The USER is authorized to use the bicycle freely, provided that he uses it reasonably and in accordance with its purpose, which notably excludes: its use on terrains or under conditions likely to damage the bicycle (prohibition in particular of using the bicycle on beaches), any use that may endanger the user or third parties, any disassembly or attempted disassembly of all or part of the bicycle.
  • 11.3 The USER must exercise caution when using the rented item and comply with traffic regulations. It is strictly forbidden to use the bicycle under the influence of alcohol or drugs or for illicit purposes.
  • 11.4 The USER is responsible for adhering to all applicable legal and regulatory obligations.
  • 11.5 Modifying the bicycle, performing repairs, transporting adult passengers (except young children), and failing to securely park the bicycle using the provided lock are prohibited.

12 – Maintenance

  • 12.1 The Lessor covers the costs associated with normal wear and tear.
  • 12.2 Throughout the rental period, the USER is responsible for maintaining the bicycle, excluding repairs that require part replacement.

13 – Repair

  • 13.1 If repairs are necessary during the rental period, the USER must promptly notify the Lessor and refrain from attempting repairs or engaging third-party repair services.
  • 13.2 Repair prices for spare parts and services displayed at the rental location are applicable. Only the Lessor can determine whether a repair falls under normal wear and tear or is the result of damage caused by the USER during the rental period.
  • 13.3 The USER is not entitled to claim compensation for loss of use or immobilization of the bicycle due to repairs.

14 – Return of the Bicycle

  • 14.1 The USER is required to return the bicycle to the same rental location within the specified deadline stated in the contract. Late returns will result in additional charges.
  • 14.2 The USER must return the equipment in the same condition as it was received, ensuring it is well-maintained and in proper working order. Any damages or impacts, particularly concerning helmets, must be reported to the Lessor.
  • 14.3 The rented equipment must be returned in a clean condition.

15 – Termination

  • 15.1 Either party has the right to terminate the rental contract at any time without prior notice or compensation in the event of non-compliance with contractual obligations.
  • 15.2 If the rental contract is terminated, the USER must immediately return the bicycle and accessories in good maintenance and working order.
  • 15.3 The USER remains responsible for the equipment in their possession and must fulfill their obligations until the items are returned.

16 – Responsibilities

  • 16.1 The USER is responsible for any traffic violations and associated fines, and shall reimburse the Lessor for any expenses incurred on their behalf.
  • 16.2 The USER is liable for any damage caused to the equipment during its use due to carelessness, negligence, fault, or improper use.
  • 16.3 In the event of theft, the USER must file a police report within 24 hours and promptly notify the Lessor. Refunds will be provided if the bicycle is found to be in good working condition, with necessary repairs deducted. Failure to provide a police report will result in immediate payment equal to the new value of a similar bicycle, and the Lessor may initiate legal action to recover the payment.
  • 16.4 If the USER is involved in theft of the equipment, the Lessor reserves the right to file a complaint and seek compensation for damages through legal action.
  • 16.5 The Lessor is responsible for addressing warranty claims related to hidden defects in the rented equipment.
